Czech Republic: Immigration Changes Effective July 1

The Czech government has announced details on the upcoming changes to the Employment Act, effective July 1. Key changes include:

Labor Market Test Exemption: Employers hiring non-EU nationals from Australia, Canada, Israel, Japan, New Zealand, Singapore, South Korea, the United Kingdom, and the United States will no longer need to conduct a labor market test. This means they will not have to publish a vacancy for these roles or wait 30 days for approval if there is a change of employer. However, this exemption does not apply to Blue Card holders or applicants.

Online Submission Requirement: All labor office registrations, deregistrations, and other changes must now be submitted online, rather than by mail or in person. This policy covers labor-related changes such as employer changes or employee transfers.

Posted Worker Notifications: Notifications for posted workers must now be submitted through the labor inspectorate’s online portal instead of in person at local labor offices.

Despite these changes, eligible foreign nationals must still register their employment status with their relevant regional branch of the State Labor Inspection Office. They are also required to obtain and maintain a valid residence permit or visa. Employers of non-EU nationals from the specified countries do not need to announce vacancies at the labor office, and no job vacancy number is required for applications.

Analysis: The Ministry of Labor and Social Affairs is easing labor market testing rules to enhance competitiveness by attracting more skills and talent to the workforce and reducing hiring costs for employers. Further updates will be provided as information becomes available.
